I have found several land patents in my grandfather and great grandfather's name and discovered that they were issued by the Crown in the Right of Canada. At present I have the certified copies from the Federal Government record keepers. According to the Statutes of Canada regarding these patents it is provided in the The Registry Act of that period that the patents be registered in a land titles office in the province for which the land is situate in order to complete the registration protocol.

My patents, although have all sorts of conveyances on the abstract, have not been registered. At first the District Registrar told us that they were registered and when asked to produce the documents stating this, recanted and said they were not registered. As heirs to these patents, we then given the forms by the land titles office to register them got an attorney to help us do this. Before we could even submit them for registration the district registrar said that we could register them all we wanted but he would not give us the land.

How does this follow? Our Attorney is clueless as is every other attorney we consulted on this issue. What do you know of registration of patents in the province of which they are situate? What is the point? Did they have to be registered in order to convey the land or not?

Your description of the situation about which you inquired did not contain sufficient information regarding the chain of title for anyone to provide a reasonable response to your inquiry. Other elements of your inquiry demonstrate incorrect presuppositions that also taint the possibility for a reasonable response. Thus, to help you resolve those incorrect presuppositions and help you learn enough for you to understand the matter (with its relevant solutions) would require Team Law beneficiary support.

At the end of your inquiry, you asked for some legal opinions; which type of opinion is limited to the realm of the courts and licensed attorneys. However, if you qualified for Team Law beneficiary support, we expect the education you would receive through that level of support (related to the first part of your inquiry) would quite effectively resolve the matter sufficiently such that you would no longer need such opinions; because you would most likely then understand the facts and law related to the matter.
